Amtex Corp - Warranty

Amtex Corp. warrants that the products described in this Limited Warranty are free from defect in workmanship and materials under normal use and service for a period of 12 months following the completion of the manufacture of the product(s). Amtex does not by this Limited Warranty duplicate any warranties of others that apply to any part(s) of the product(s) and assigns to Buyer all rights to any such warranty. This warranty does not cover items such as heater, air conditioner, hot water heater, tires and other components which are purchased by Amtex from recognized manufacturers and carry their own warranty, not does it cover any building that has been subjected to misuse, neglect, accident, or any unreasonable use or improper care. Amtex’s sole obligation under this Limited Warranty shall be to repair or replace, at Amtex’s sole option, any defective part or workmanship not covered by any warranty by any other party. Amtex shall have no liability for consequential, special or incidental damages or any other loss which may result from any defect.

Parts or workmanship covered by this Limited Warranty and found defective will be repaired or replaced by Amtex at Amtex’s expense upon receipt by Amtex within such 12 month period of written notice specifically describing such defect. Amtex shall not be liable for repairs performed by any other entity or person. Should any failure to conform with the foregoing warranty appear within such one (1) year period, Amtex will, at their option, either repair or replace the defective part, F.O.B. Amtex’s factory or such other place as may be mutually agreed upon in writing by Amtex and purchaser. The remedy herein provided in Amtex’s only obligation and the sole and exclusive remedy for failure by Amtex to conform to the foregoing warranty. In no event shall Amtex be liable for incidental or consequential damages, including by way of illustration and not limitation, loss of profits and loss of other property or equipment, unless such damages are of personal injury.

This Limited Warranty is limited to Buyer and the original purchaser from Buyer and is not transferable.

Buyer, in furnishing specifications to Amtex, agrees to defend, indemnify and hold Amtex harmless against any claims by way of infringement or the like that arise out of compliance with the specifications.

DISCLAIMER OF IMPLIED WARRANT OF MERCHANTABILITY

The foregoing warranty is expressly in lieu of all other warranties, whether expressed or implied, including but not limited to, the implied warranties or merchantability and fitness for a particular purpose. It is specifically agreed that the product(s) covered by this Limited Warranty are sold without any warranty of merchantability.

DISCLAIMER OF IMPLIED WARRANTY

It is specifically agreed that the product(s) covered by this Limited Warranty are sold without any warranty of fitness for any particular purposes whatsoever with respect to the product(s) being sold under this Limited Warranty.
